Wind and Solar Land Leasing in Baca County, Colorado
Baca County's strong, consistent wind and abundant sun have drawn real renewable-energy projects, particularly around Two Buttes, backed by a major regional transmission buildout. Because unincorporated Baca County has no general zoning code, a wind or solar lease here doesn't clear a typical special-use permit process the way it would in most Colorado counties -- here's what actually applies.
This page covers what's specific to Baca County. For the general explanation, see the national guide.
Real, named projects -- not just speculative interest
Renewable-energy interest in Baca County is concrete, not speculative: the Stellar Renewable Power Two Buttes Solar Storage Project, a roughly 2,240-acre proposed solar-plus-storage facility near a new substation a few miles from the hamlet of Two Buttes, has already been through public hearings locally. The area has also seen wind development, including projects referred to regionally as Twin Buttes, with capacity in the tens of megawatts. Behind both is Xcel Energy's roughly $1.7 billion, 450-mile transmission loop around the eastern plains, built specifically to move new wind and solar generation out of counties like Baca to load centers elsewhere in the state.
If a parcel is being marketed with reference to renewable-energy potential, ask specifically whether it's already under an executed lease, an option agreement, or simply sits within a developer's broader area of interest -- those are very different positions, and general regional enthusiasm for wind and solar doesn't mean a specific parcel has, or will get, an active project.
No zoning to clear -- but that doesn't mean no process at all
Because unincorporated Baca County has no general zoning code, a wind or solar project here doesn't go through the special-use-permit or rezoning process that would apply in a fully zoned county. That doesn't mean there's no local process whatsoever: the county's septic (OWTS) permitting still applies to any structure needing one, county road-use and right-of-way permits apply to construction traffic and any new access built for a project, and a large-scale project will still need its own state and federal permits (interconnection approval, environmental review tied to transmission, and similar) independent of anything at the county level.
For a landowner considering a lease rather than a buyer evaluating leased land, the county's own land-use letter from the Board of County Commissioners remains the reference point for any land-use question specific to the parcel, precisely because there's no zoning code to consult instead.
What to verify before treating a lease as bankable
- The lease term, payment structure (upfront bonus versus per-acre or per-turbine/per-megawatt royalty), and whether payments are contingent on the project actually being built and interconnected -- an option-stage agreement often pays far less than an operating-stage lease.
- Whether the project depends on the Xcel transmission buildout or another specific interconnection point actually being completed on schedule, since transmission timelines for large regional projects have shifted before.
- Decommissioning obligations at the end of the lease term, and whether the developer or landowner is responsible for removal costs.
- Any local opposition or unresolved public-hearing conditions on a specific named project, since Eastern Plains renewable development has drawn real community pushback in some Colorado counties.
