Subdividing Land in La Plata County, Colorado
Beyond the legal-lot-of-record threshold covered on the county hub, La Plata County changed how it processes plat modifications in 2026 -- dropping a longstanding requirement to collect neighbor sign-off before applying, which is worth knowing if you're planning to re-plat or split an existing parcel here.
This page covers what's specific to La Plata County. For the general explanation, see the national guide.
A 2026 code change removed the 67% neighbor-consent requirement
As part of an ongoing Land Use Code review effort, La Plata County's Planning Division has been working through a 2026 Code Amendments Workplan, developed with its Code Improvement Team, aimed at removing procedural barriers that don't add real review value. One of the changes coming out of that process: the county eliminated the previous requirement that anyone applying to modify a recorded subdivision plat first collect signed consent from 67% of the neighboring property owners within that subdivision before the county would even accept the application. That consent-gathering step had functioned as a real, sometimes difficult-to-clear procedural hurdle -- getting two-thirds of neighbors to sign off before you could even apply, regardless of the merits of the modification itself.
Removing that requirement doesn't mean plat modifications go unreviewed -- the county's substantive Land Use Code review standards for a plat change still apply, including whatever legal-lot-of-record, subdivision, and Chapter 90 standards would otherwise govern the parcel (see the county hub for those). What's changed is the up-front procedural gate: an applicant no longer has to secure supermajority neighbor buy-in before the county will process the request. If you're considering buying a parcel with an eye toward re-platting it, or already own land here and are weighing a plat modification, this makes that path meaningfully more accessible than it was before 2026.
A related change: fast-track review for affordable-housing subdivisions
Separately, La Plata County adopted Resolution No. R-2026-19, creating an expedited "fast-track" review process for qualifying affordable-housing development under Colorado's Proposition 123 program -- the county opted into Proposition 123 on October 18, 2023, committing to add 108 affordable housing units by the end of 2026 in exchange for access to the state's Affordable Housing Fund and a requirement to offer expedited review to qualifying projects. If a subdivision or development proposal you're evaluating is structured to include affordable, income-restricted units, ask the Planning Division whether it qualifies for this fast-track review path -- it can materially shorten the standard subdivision review timeline for the parts of a project that meet the state's affordability criteria.
Both changes reflect a broader push in La Plata County's Planning Division to make its Land Use Code more permissive toward new housing supply, done in coordination with the Regional Housing Alliance -- county staff have signaled additional housing-related code amendments are expected later in 2026 and into 2027. If subdivision timing matters to your purchase or development plan, it's worth checking with the Planning Division for the current state of these ongoing amendments rather than assuming the code is static.
