Buying Land in Effingham County, Illinois

Effingham County sits at the I-70/I-57 interchange in south-central Illinois -- the literal "Crossroads of Opportunity." The most important fact for a land buyer here has nothing to do with the highways: unlike most Illinois counties, Effingham County has never adopted countywide zoning. That means more building freedom in unincorporated areas than you'll find almost anywhere else in the state, with a few real exceptions worth checking first.

No Countywide Zoning -- No Building Permit Required in Unincorporated Areas

Case-by-case / verify locally

Effingham County has not adopted a zoning ordinance for unincorporated territory. The county's own posted guidance, issued through the Highway & Engineering Department, states plainly that because zoning does not exist countywide, building permits and Certificate of Occupancy permits are not required for construction in unincorporated Effingham County. That's unusual freedom by Illinois standards -- and it cuts both ways: there's no zoning district to check before building, but there's also no county-level review of what your neighbor builds next door.

Cities and the 1.5-Mile Ring Around Them Are a Different Story

Case-by-case / verify locally

Zoning does exist inside Effingham County's incorporated municipalities, and at least the City of Effingham and the Village of Teutopolis are reported to exercise extraterritorial zoning jurisdiction reaching roughly 1.5 miles beyond their corporate limits. If a parcel is anywhere near Effingham, Teutopolis, or another town in the county, don't assume the "no county zoning" rule applies -- call that specific municipality directly to check whether its own zoning or extraterritorial reach covers the parcel.

Subdivision Review and Floodplain Rules Still Apply, Even Without Zoning

Generally favorable

The absence of zoning doesn't mean an absence of every county land-use rule. Effingham County has its own Subdivision Ordinance (Ordinance No. 09-64) governing how raw land gets divided into lots, and the county participates in the National Flood Insurance Program with an adopted floodplain management ordinance -- meaning any construction in a mapped floodplain still needs a floodplain permit regardless of the county's no-zoning status. See our dedicated zoning page for Effingham County for what these mean in combination.

No zoning: what that actually changes for a buyer

Effingham County is one of the relatively few Illinois counties that has never adopted a zoning ordinance under 55 ILCS 5 Division 5-12 for its unincorporated territory. The county's own guidance document -- issued through the Highway & Engineering Department at 101 N. Fourth Street, Effingham -- states that because no countywide zoning exists, a building permit or Certificate of Occupancy is not required to build in unincorporated Effingham County. For a buyer used to other Illinois counties (or other states), that's a meaningfully different starting point: there's no zoning district classification to research, no use-permitted-by-right table to check, and no county building inspector approval gating construction on raw land outside a town.

See our dedicated zoning page for Effingham County for the fuller picture -- what still does apply (subdivision review, floodplain rules, municipal extraterritorial reach near towns) and what a lack of county zoning means in practice for things like manufactured homes, accessory structures, and neighboring land uses that in a zoned county would be separated by district.

The Crossroads of Opportunity: I-70 and I-57

Effingham, the county seat, sits at the interchange of Interstate 70 (running Utah to Maryland) and Interstate 57 (running Chicago to Sikeston, Missouri) -- a genuine cross-country crossroads that the city brands as "The Crossroads of Opportunity." The intersection is marked by The Cross at the Crossroads, a 198-foot-tall roadside cross completed in 2001 that an estimated 20 million vehicles pass each year. For a land buyer, that interstate access is a real locational asset for commercial or logistics-adjacent parcels near the interchange, distinct from the county's broader agricultural land base further from the highways.

Septic, subdivision, and other departments to know

Septic (private sewage disposal) permitting runs through the Effingham County Health Department (901 W. Virginia Avenue, Effingham) under the statewide IDPH Title 77 Part 905 code, as it does throughout Illinois: submit a Private Sewage Disposal Plan Review Application and fee, and give the department at least 24 hours' notice before installation begins. This applies regardless of the county's no-zoning status -- septic permitting is a separate, state-driven system administered locally.

Effingham County's Subdivision Ordinance (No. 09-64) still governs how raw land is divided into lots in unincorporated areas, and the county's participation in the National Flood Insurance Program means floodplain construction permits are still required for work in a mapped Special Flood Hazard Area, even though general zoning and building permits are not. University of Illinois Extension serves Effingham County jointly with Clay, Fayette, and Jasper Counties from its office at 1209 Wenthe Drive in Effingham -- a useful first call for agricultural land-use questions in this heavily farmed county.
