Wind and Solar Land Leasing in Labette County, Kansas

Labette County has become a genuine target for renewable-energy developers -- at least nine companies interested in lithium battery storage, wind, and solar, including a Plus Power battery-storage deal reported to bring roughly $25 million to the county and a 400-megawatt AES Clean Energy solar project. But the county's first-ever zoning code, adopted in July 2024, arrived at the same moment and now puts some of those same projects in stated jeopardy -- a landowner weighing a lease here is stepping into an active, unresolved local fight, not a settled market.

This page covers what's specific to Labette County. For the general explanation, see the national guide.

Real, named projects -- and a real, named conflict with the new zoning

Labette County's renewable-energy interest is concrete, not speculative: at least nine developers have shown interest in lithium battery storage, wind, or solar projects in the county, and two are specific and publicly reported. Plus Power has an agreement for a battery-storage facility reported to bring roughly $25 million directly to county coffers, and AES Clean Energy has proposed a 400-megawatt solar project spanning North and Neosho townships in the northeast part of the county. Both arrived around the same time as Labette County's first-ever county-wide zoning code, adopted by Resolution No. 2024-24-L on July 12, 2024 -- and County Commissioner Cole Proehl has said publicly that both projects are now in jeopardy under the zoning maps and regulations as adopted, prompting his own call for broader countywide representation on the zoning and planning board.

For a landowner approached about a lease -- whether for a large solar array, a wind project, or a battery-storage site -- this is the single most important thing to establish before signing anything: does the specific parcel's zoning district, as mapped under the July 2024 regulations, actually permit the proposed use, or does it fall into the same category of projects the county's own commissioner has said are now at risk? A lease payment schedule that assumes smooth permitting is a materially weaker commitment here than the same lease would be in a county with a longer-settled energy-zoning framework.

The zoning administrator's own framing, and what to verify before signing

Labette County's Zoning Administrator, Mel Haas, has said directly that zoning is the county's chosen tool for controlling how these renewable-energy industries develop in the county going forward -- meaning the zoning code isn't an incidental hurdle to a lease here, it's the deliberate mechanism the county is using to decide which projects proceed and on what terms. The regulations apply to the unincorporated area (excluding the City of Parsons' own extraterritorial zoning jurisdiction) and exempt agricultural uses as Kansas statute requires, with a Zoning Administrator and Planning Board handling permits, variances, and conditional-use applications for everything else, including large energy projects.

Before treating any Labette County wind, solar, or battery-storage lease offer as reliable, verify three things directly with the county rather than the developer alone: first, the parcel's current zoning district and whether the proposed use is permitted, conditional, or effectively excluded under the adopted maps; second, whether the specific project named in the lease (or a comparable one) has an active permit application, and at what stage; and third, whether the Board of County Commissioners has taken up -- or is actively considering -- any amendment to the July 2024 regulations in response to the developer pushback, since Commissioner Proehl's public comments suggest the current rules may not be their final form. None of that diligence is optional here in the way it might be in a county with a decades-old, uncontested energy-zoning framework.
