Buying Land in Cook County, Minnesota

Cook County, seat Grand Marais, is Minnesota's northeasternmost county -- Lake Superior's North Shore on one side, the Boundary Waters Canoe Area Wilderness and Grand Portage Reservation carved into the rest. Over three-quarters of the county's land is federal or state-owned, chiefly Superior National Forest. Cook County itself administers both zoning (with a Lake Superior-specific shoreland standard distinct from the state's usual inland-lake rules) and Wetland Conservation Act determinations countywide. And land status here is not static: the Grand Portage Band of Lake Superior Chippewa regained roughly 87 acres of historically significant land within the reservation as recently as March 2026.

Lake Superior Gets Its Own Shoreland Standard, Not the Usual Inland-Lake Rule

Generally favorable

Cook County's Zoning Ordinance #37 sets the required structure setback along Lake Superior at 40 feet from the vegetation line -- a specific, tighter-in-absolute-terms figure than the 1,000-foot shoreland zone that applies around Minnesota's inland lakes under the statewide Rule 6120 framework. That's because Lake Superior's North Shore is separately governed by a state-required North Shore Management Plan, which sets minimum standards specifically for subdivision, use, and development of Lake Superior shoreland (outside the Duluth planning area) that Cook County, like Lake County, must meet or exceed. For a buyer, this means Lake Superior frontage in Cook County follows its own distinct setback and development standard -- confirm the parcel's Lake Superior shoreland classification and the applicable North Shore Management Plan standards directly with the county rather than assuming the general inland-lake shoreland rules apply.

Over Three-Quarters of the County Is Public Land

Case-by-case / verify locally

Cook County contains roughly 1.03 million acres, and per the county's own reporting on federal Payment in Lieu of Taxes (PILT), approximately 63.6% is under federal jurisdiction (chiefly the U.S. Forest Service's Superior National Forest, which includes the Boundary Waters Canoe Area Wilderness) and another 13.4% is state-controlled -- meaning more than three-quarters of the county's land base sits outside the private real estate market entirely. This constrains where private parcels exist and can concentrate demand (and price pressure) on the private land that remains, particularly land with any lake access or proximity to the BWCAW entry points. Because so much of the county is tax-exempt federal and state land, the county receives PILT payments in lieu of property tax revenue -- a 2018 federal appraisal reduced Cook County's PILT payment from roughly $2,025,000 to about $1,300,000, illustrating how sensitive county finances are to that federal land valuation.

Grand Portage Reservation Land Status Changed as Recently as February 2026

Could not confirm

The Grand Portage Reservation occupies Cook County's extreme northeastern tip, bordered by Canada to the north, Lake Superior to the south and east, and Grand Portage State Forest to the west. Land status here is not static: in February 2026, the Grand Portage Band of Lake Superior Chippewa closed on a private, philanthropically-funded buyback of roughly 87 acres of historically significant land -- a fee-simple purchase, not a federal trust-land transfer, which changes how a nearby parcel's status should actually be verified. See our dedicated tribal trust land status page for the mechanics and verification steps. For any parcel in or near the reservation boundary, confirm current trust/fee status and jurisdiction directly with the county and, where applicable, the Grand Portage Band -- a general reservation map may not reflect the current, parcel-level picture.

Zoning: countywide, with a Lake Superior-specific shoreland standard

Cook County administers land use through Zoning Ordinance #37, most recently versioned March 22, 2022. Article 8 of the ordinance sets shoreland standards, and for Lake Superior specifically, the required structure setback is 40 feet from the vegetation line -- a notably different figure, in absolute terms, from the 1,000-foot shoreland zone that applies around the state's inland lakes. That difference exists because Lake Superior's North Shore is governed under its own state-required North Shore Management Plan, which sets minimum subdivision, use, and development standards for Lake Superior shoreland (outside the City of Duluth's own planning jurisdiction) that local governments -- Cook County, Lake County, and others along the shore -- must adopt as at least as restrictive as the plan requires. The City of Grand Marais applies a matching 40-foot Lake Superior vegetation-line setback in its own zoning code.

Beyond the Lake Superior-specific standard, general shoreland regulation around Cook County's many inland lakes and streams follows the standard statewide Rule 6120 framework described on our Minnesota state page. Given how much of the county's land is federal or state forest (see below), confirm early in due diligence whether a specific parcel is even privately held, and if so, which shoreland classification and setback apply -- Cook County's Land Services department (which also handles building permits and general zoning questions) is the right first call.

Land status: mostly public, and still actively changing near Grand Portage

Cook County's land base is dominated by public ownership. Of the county's roughly 1.03 million acres, approximately 63.6% is federally owned -- primarily Superior National Forest, within which the Boundary Waters Canoe Area Wilderness sits and cannot be commercially managed or privately developed -- and another 13.4% is state-owned, together putting more than three-quarters of the county outside the private market. Because this land is tax-exempt, the federal government pays the county Payment in Lieu of Taxes (PILT) based on a decennial appraisal; the most recent appraisal (2018) actually reduced Cook County's PILT payment from about $2,025,000 to roughly $1,300,000, illustrating how directly county finances and, indirectly, county land-use priorities can be affected by federal land valuation decisions well outside local control.

The Grand Portage Reservation, in the county's extreme northeastern corner along Lake Superior and the Canadian border, adds a further layer: land status there is not fixed. Most recently, the Grand Portage Band of Lake Superior Chippewa completed a private buyback of roughly 87 acres of historically significant land in February 2026, funded by a philanthropic grant rather than a federal trust-land transfer -- a distinction that matters for how a nearby parcel's status is actually verified; see our dedicated page below. Cook County itself administers the Wetland Conservation Act for all private land in the county and the City of Grand Marais, per the county's own Land Services wetlands page -- but for any parcel at or near the Grand Portage Reservation boundary, confirm current trust/fee land status directly with the county and the Band before assuming standard county jurisdiction applies.

Who to Call Before Buying Land in Cook County

We could not confirm a direct email for Land Services/Planning & Zoning, the WCA contact, the Assessor, the Recorder, or the Soil & Water Conservation District beyond the phone numbers listed. For any parcel at or near the Grand Portage Reservation boundary, contact the Grand Portage Band of Lake Superior Chippewa's own land and natural resources office directly in addition to the county -- we did not identify a public direct-dial contact for that office and did not include it here to avoid listing an unverified stub.
