Buying Land in Richardson County, Nebraska
Richardson County, seat Falls City, sits in Nebraska's southeast corner along the Missouri River. It's one of just a handful of Nebraska counties with no zoning regulations at all -- but that's actively changing, with a new Comprehensive Plan and Planning Commission underway as of 2025-2026. The whole county falls in one NRD, the Nemaha NRD, which is also the referee in a live, cross-county water dispute between a Richardson County water district and its neighbor in Pawnee County.
No zoning yet, but a comprehensive plan and Planning Commission are already at work
Richardson County is genuinely different from most of the counties covered on this site in one specific way: it has no zoning regulations in effect at all. County Board members have publicly described Richardson, along with neighboring Nemaha County, as one of only five Nebraska counties without zoning. That means -- as of this writing -- there's no county-level zoning district map, no permitted-use table, and no county zoning permit process to check before building or developing rural land outside any incorporated town. Nebraska law does allow (Neb. Rev. Stat. Ch. 23) but does not require county zoning, and Richardson County is a live example of a county that has gone decades without adopting it.
That status is actively in motion, though, which matters for anyone planning to hold land here for more than a year or two. The County Board voted in late 2024 to move forward on updating the county's Comprehensive Plan, last completed roughly 25 years earlier, and contracted with Marvin Planning Consultants to do the work -- a comprehensive plan being the required legal predicate under state law before any zoning regulations can be adopted. A County Planning Commission has since been formed, and per local reporting through mid-2026, it has been presenting draft planning guidance back to the County Board, with poultry and livestock production facilities, renewable-energy facilities, and road infrastructure specifically named as subjects the plan is meant to address -- suggesting the eventual zoning code, if adopted, would likely focus first on siting rules for large agricultural operations and energy projects rather than broad residential-use restrictions. Because there is no dedicated zoning office yet, route any planning or comprehensive-plan-status questions to the County Clerk's office, which handles County Board business, and ask directly whether zoning has since been adopted -- this is a genuinely moving target.
One NRD, and a live well dispute worth checking before you rely on rural water
Groundwater governance in Richardson County is straightforward on paper: the entire county sits within a single Natural Resources District, the Nemaha NRD, headquartered in Tecumseh, which also covers Johnson, Nemaha, Otoe, and Pawnee Counties. There's no internal watershed boundary splitting Richardson County the way there is in some other Nebraska counties. But "one NRD" being simple doesn't mean the underlying water situation is conflict-free.
We were specifically asked to verify a cross-county pipeline dispute described as involving a "Whelan pipeline," Richardson County, and Pawnee County or the Nemaha NRD. We could not confirm any project by that specific name after extensive search, and that name should be treated as unconfirmed rather than repeated as fact. What we did verify, and what appears to be the actual underlying dispute, is this: the City of Humboldt (in Richardson County) and Richardson County Rural Water District No. 1 have spent roughly five years and about $60,000 drilling 20 to 30 test holes in search of a new well site to solve a nitrate-contamination problem in their existing supply, with the plan to blend low-nitrate water from the new source with the higher-nitrate water from their existing wells north of Humboldt to meet the federal drinking-water standard. That prospective well site sits just across the county line in neighboring Pawnee County -- and Pawnee County's commissioners voted unanimously to oppose it, worried about the effect on their own county's wells nearby. As of June 2025 reporting, Nemaha NRD -- which holds groundwater well-permitting authority over both counties -- was reported to be working directly with the Richardson County side toward a resolution, but no final outcome was confirmed in research. If a parcel you're evaluating relies on Richardson County Rural Water District No. 1 service, or on a well anywhere near the Pawnee County line, ask both the rural water district and Nemaha NRD for the current status of this specific dispute before assuming water supply or well-permitting is settled.
Who to Call Before Buying Land in Richardson County
The county has no separate planning/zoning department to list because no zoning ordinance is currently in effect -- we route planning-process questions to the County Clerk's office, which handles County Board and Planning Commission business, pending a dedicated zoning office if and when zoning is adopted. We could not confirm a direct contact for building/permitting, environmental health/septic, or floodplain/stormwater in Richardson County beyond the state-level Title 124 septic framework described on this site's Nebraska state hub; ask the County Clerk's office to route those inquiries. We also could not confirm a general public-inquiry email for the Nemaha NRD beyond the phone number listed.
