Zoning in Northampton County: Township-by-Township Warehouse Fights

Every municipality in Northampton County writes its own zoning ordinance under Pennsylvania's Municipalities Planning Code -- there's no county-wide backstop. In the last several years, at least three different Northampton County townships have run real, documented fights over whether industrially zoned land should keep permitting large-scale warehouse development, with three different outcomes. If you're looking at land anywhere near an industrial or airport-corridor zoning district here, that township-by-township pattern is exactly what you need to check.

This page covers what's specific to Northampton County. For the general explanation, see the national guide.

Three townships, three different outcomes -- this is a pattern, not an anecdote

Lower Nazareth Township's supervisors voted unanimously in early 2023 to amend the township's zoning ordinance, deleting warehouses and distribution centers as a use permitted by right within a Planned Business Development inside the township's light industrial zoning district. At the time, the township already had three warehouse applications in the pipeline that were grandfathered in and unaffected by the change; the amendment applies only to future applications, which would now have to seek space in the more limited general-industrial district instead. Local reporting described Lower Nazareth as the first of what was expected to be a wave of roughly ten Northampton County municipalities to make a similar move, with then-county executive Lamont McClure publicly applauding the coordination between municipalities working through the Lehigh Valley Council of Governments.

Hanover Township -- the Northampton County township near Lehigh Valley International Airport, not the similarly named township across the county line in Lehigh County -- has run a separate, still-live fight over a proposed 2.1-million-square-foot warehouse business park. The developer, Majestic Realty, leases roughly 300 acres from the Lehigh-Northampton Airport Authority, sited within the township's Aircraft Flightpath Highway Business Zoning District (AFHBD), most of which was undeveloped agricultural land at the time of the proposal. And in East Allen Township, the zoning hearing board went a different direction still, rejecting a separate warehouse developer's specific variance and special-exception requests -- a reminder that "industrially zoned" doesn't automatically mean every proposed warehouse gets approved even where the underlying use is allowed.

Why individual townships can restrict future warehouses but can't easily reject one already permitted

The mechanism behind all three outcomes is the same piece of Pennsylvania zoning law: a municipality generally has real difficulty rejecting a specific proposed use that its own zoning ordinance already permits by right in that district, however much local opposition it draws -- that's why Lower Nazareth had to change its zoning text going forward rather than simply denying the three warehouse applications already in its pipeline, and why the practical fight in Hanover Township centers on the AFHBD district's own permitted-use list and any pending amendment to it. East Allen's rejection, by contrast, suggests that township's zoning either didn't clearly permit the specific proposal by right or that the developer's application ran into a genuine variance or special-exception standard it couldn't meet -- a materially different legal posture than Lower Nazareth's or Hanover's.

What to check before buying land near an industrial or airport-corridor district here

Three concrete steps for a Northampton County parcel: (1) confirm the parcel's current zoning district and, specifically, whether warehouse or logistics use is permitted by right in that district today, not just whether the area is broadly described as "industrial" or near an airport; (2) ask the specific township directly whether any zoning-text amendment restricting or banning warehouse development is pending, recently adopted, or under discussion -- Northampton County has real, multi-township momentum in this direction since 2023, coordinated in part through the Lehigh Valley Council of Governments; and (3) if the land sits in or near Hanover Township's AFHBD district specifically, ask about the current status of the Majestic Realty business-park proposal and any related zoning-amendment activity, since that fight was still live as of the most recent reporting available in this pass.
