The Delaware River Basin Fracking Ban in Wayne County, Pennsylvania
Most Pennsylvania Marcellus Shale counties are defined by how much gas activity is happening. Wayne County is defined by the opposite: the resource is there, but an interstate regulatory body has permanently and legally foreclosed developing it. Here is the specific legal history behind that, and what it means for a parcel with mineral rights attached.
This page covers what's specific to Wayne County. For the general explanation, see the national guide.
Why a four-state commission, not Pennsylvania alone, controls this
Wayne County's Marcellus Shale gas reserves fall within the Delaware River Basin -- the watershed of the river that supplies drinking water to Philadelphia and to roughly half the population of New York City. Because of that basin-wide public-water-supply stake, the Delaware River Basin Commission (DRBC), a regulatory body created by a 1961 interstate compact among Pennsylvania, New Jersey, New York, and Delaware, has jurisdiction over water-resource decisions in the basin -- including, as it turned out, whether hydraulic fracturing can happen there at all. This is fundamentally different from how gas development is regulated in the rest of Pennsylvania's Marcellus counties, where PA DEP alone administers permitting.
The DRBC imposed a de facto moratorium on shale-gas drilling starting in 2010, initially framed as a pause while the commission worked out permitting rules. That pause lasted far longer than a typical rulemaking process, and in 2017 the commission changed direction entirely, moving to draft regulations that would formally and permanently ban the practice rather than eventually permit it. On February 25, 2021, with representatives of all four basin states voting in favor, the DRBC adopted final regulations permanently banning hydraulic fracturing and associated natural gas development basin-wide, citing documented risk to drinking water, surface water, and groundwater quality.
A real fight over property rights, now resolved
Wayne County landowners did not accept the moratorium quietly. A landowner organization known as the Northern Wayne Property Owners Alliance, litigating under the entity name Wayne Land and Mineral Group, LLC, filed suit against the DRBC in 2016, while the commission was still deliberating rather than having finalized a ban. Their argument was a regulatory-takings claim: that the DRBC's ongoing refusal to permit development amounted to an unconstitutional taking of the value of their severed or leased mineral rights without just compensation.
The case worked through federal court for close to nine years. In February 2025, U.S. District Judge Robert D. Mariani dismissed the Wayne Land and Mineral Group suit, ruling it had become moot: once the DRBC adopted its final, basin-wide fracking ban in 2021, the specific regulatory uncertainty that originally motivated the lawsuit no longer existed in the same form, since there was no longer any live possibility of a differently-resolved permitting decision to challenge. The practical effect for a land buyer is that this is now settled legal history, not an open question -- there is no pending case that could reopen the door to fracking in Wayne County in the near term, and DEP's own review of the matter closed the door on new fracking-plan submissions to the DRBC as a matter of law.
