Zoning in Davison County, South Dakota

The hub covers Mitchell's one-mile extraterritorial zoning ring. What it doesn't cover is that Mitchell holds a second, separate authority reaching a full three miles out -- and a Davison County parcel in that outer band can need county zoning approval and a City of Mitchell plat sign-off at the same time.

This page covers what's specific to Davison County. For the general explanation, see the national guide.

Two different rings, two different South Dakota statutes

South Dakota law gives municipalities two distinct kinds of authority outside their own city limits, and they don't reach the same distance. Under SDCL 9-29-1, a municipality can exercise general zoning-type jurisdiction -- covering building permits, conditional use permits, and variances -- within one mile of its corporate limits; this is the Extraterritorial Jurisdiction (ETJ) ring the Davison County hub already describes for land near Mitchell. But under a separate statute, SDCL 11-6-26, a municipality that has adopted a comprehensive plan and major street plan may also claim subdivision-platting authority reaching up to three miles from its corporate limits -- a wider ring, and a narrower power (it governs approval of plats, not general zoning or building permits).

Mitchell has adopted both. The practical result for a Davison County parcel sitting between one and three miles from Mitchell's city limits: ordinary zoning authority -- what use is allowed, what a building permit requires -- stays with Davison County's Planning and Zoning Office, since that land is outside the one-mile ETJ ring. But if you want to subdivide that same parcel, creating a new plat requires the City of Mitchell's approval before the county can proceed to recording, even though the county otherwise governs the land's zoning. This is a real, two-jurisdiction structure, not a single hand-off at the one-mile line -- a parcel can be governed by the county for use and permitting purposes while still needing city sign-off for a plat.

Who to actually contact for which piece

For general zoning, building permits, and use questions on land outside the one-mile ETJ ring, Davison County's Planning and Zoning Office (Jeff Bathke, Administrator) remains the right contact, as the hub describes. For subdivision and platting matters specifically -- whether a parcel sits inside the one-mile ETJ ring or in the one-to-three-mile platting-only band -- the City of Mitchell's Planning and Zoning Department (Mark Jenniges is the city's listed initial contact for development and subdivision matters, at (605) 995-8433) is the office that actually reviews and approves the plat under Title 11 of the Mitchell City Code, with the city's Planning Commission voting on subdivision applications before they can be recorded.

The concrete takeaway for a buyer: before assuming a parcel two miles outside Mitchell can be freely split into smaller lots under county rules alone, confirm with the City of Mitchell's Planning and Zoning Department whether the parcel falls within its three-mile platting jurisdiction -- and if a use or building-permit question is what you're actually asking, confirm separately with Davison County whether that same parcel falls inside or outside the narrower one-mile ETJ ring, since the two boundaries answer different questions and don't move together.
