Subdividing Land in Hughes County, South Dakota

Splitting a parcel in Hughes County means first figuring out which review track it falls into -- a streamlined minor-plat process, or the fuller major-subdivision review -- and, separately, whether the land sits close enough to Pierre that the city, not the county, has a seat at the table.

This page covers what's specific to Hughes County. For the general explanation, see the national guide.

Minor plat or major subdivision: the split determines how much review you face

Hughes County's Subdivision Ordinance, administered by the Planning & Zoning Department, sorts every proposed split into one of two tracks. A minor subdivision creates more than one but not more than four lots fronting an existing street, does not require a new street or the extension of municipal facilities or public improvements, does not adversely affect the remainder of the parcel or adjoining property, and does not conflict with the county's Comprehensive Plan, Official Map, or Zoning Ordinance -- that combination of conditions has to hold, not just the lot count, so a four-lot split that would require running a new road in is not automatically a minor plat. Everything else is a major subdivision: five or more lots, or any split of any size that requires a new street, extends public facilities, or creates public improvements, and that track brings a fuller review by the Planning Commission and County Commission.

Before assuming your split qualifies as minor, confirm with Planning & Zoning whether your plan trips any of the disqualifying conditions -- a new access road to reach a back lot, or a shared well or septic arrangement the county reads as a public-improvement extension, can push a small split into major-subdivision review even when the lot count alone looks minor. The department also administers the county's Flood Damage Prevention, Rural Addressing, and Building Code ordinances alongside the Subdivision Ordinance, so a new lot in a mapped flood hazard area or one that needs a new address assignment involves those additional steps regardless of which plat track applies.

Land within three miles of Pierre: a joint city-county process, not a county-only one

South Dakota law lets a municipality extend its subdivision review authority up to three miles beyond its own corporate limits, and the City of Pierre has done exactly that. Inside that extraterritorial ring, a joint Hughes County-City of Pierre Planning Commission handles subdivision review for both jurisdictions together, and plats have to meet the city's own minimum subdivision requirements, not only the county's. A parcel that reads as straightforwardly "Hughes County land" on a listing can, once you check the distance to Pierre's city limits, actually fall inside this joint-review zone -- meaning the standard county-only minor/major plat process described above is not the whole picture for that specific tract.

Practically, that means the first question before platting anything near Pierre isn't just "minor or major" but "county only, or joint city-county." Measure or ask Planning & Zoning for the parcel's distance from Pierre's corporate limits, and if it falls inside the three-mile extraterritorial area, expect the city's subdivision design and improvement standards -- which are typically more detailed than a rural county's -- to apply on top of, or in place of, the county's own requirements. Get this confirmed in writing from Planning & Zoning before you invest in survey and platting costs based on an assumption about which set of rules governs.
