Zoning in Cooke County, Texas
Almost no rural Texas county has real zoning authority, but Cooke County does, in a narrow band around Lake Ray Roberts: a state law exception lets the county enforce actual zoning districts, lot-size minimums, and building rules there, while the rest of the county remains unzoned.
This page covers what's specific to Cooke County. For the general explanation, see the national guide.
Why Cooke County has zoning at all
The Texas hub explains that counties generally have no general zoning authority, with a short list of named exceptions carved out in Local Government Code Chapter 231. Cooke County falls under one of those exceptions: Subchapter F of Chapter 231 authorizes zoning specifically around Lake Ray Roberts, a reservoir on the Elm Fork Trinity River shared between Cooke and Denton Counties. Rather than leave that authority unused, Cooke County's Commissioners Court adopted an implementing Lake Ray Roberts Zoning Ordinance on February 10, 2003, and readopted updated Lake Ray Roberts Zoning Regulations on March 11, 2019 -- a real, current ordinance, not a dormant grant of power.
This zoning authority applies only within the defined lake area, not countywide. Cooke County's own zoning documents describe the regulated 'lake area' as generally the land within 5,000 feet of the project boundary line, defined by the lake's 645-foot elevation take line. Land elsewhere in Cooke County -- away from Lake Ray Roberts -- is not zoned and instead falls under the county's general subdivision regulations, covered on the county hub.
What the ordinance actually regulates
Like a municipal zoning ordinance, the Lake Ray Roberts Zoning Regulations establish distinct zoning districts and, within each, set rules for building height and size, the percentage of a lot that can be built on, minimum yard dimensions, population density, and what a building can be used for (residential, commercial, or otherwise). The regulations are not uniform across the lake area: at least one residential district set out in the 2019 regulations is aimed at family-residential development on lots of 20,000 square feet or larger, located close to Interstate 35 and inside the extraterritorial jurisdiction (ETJ) of the City of Valley View -- meaning a parcel there can be subject to both this county zoning district and Valley View's own ETJ subdivision requirements. A separate district identified in the regulations sets a larger 1.5-acre minimum lot size, reflecting a lower-density standard elsewhere in the zoned lake area. The full set of districts, their boundaries, and their complete dimensional tables are laid out in the county's posted zoning regulations document and official zoning map, not summarized in full here.
Because the district a parcel falls into determines its minimum lot size, setbacks, and allowed uses, and because the boundary between zoned lake-area land and unzoned county land is itself geographic (tied to the 645-foot take-line contour and the 5,000-foot buffer), a buyer should not assume which rules apply based on general proximity to the lake alone.
Before buying near Lake Ray Roberts in Cooke County
- Confirm directly with Cooke County's Lake Ray Roberts Planning & Zoning office whether a specific parcel falls inside the zoned lake area (generally within 5,000 feet of the 645-foot take line) or outside it under the county's general, unzoned rules.
- If the parcel is inside the zoned area, get the specific zoning district it falls into and that district's minimum lot size, setback, height, and use rules from the county's current zoning regulations and official district map -- do not rely on a single district's numbers (like the 20,000-square-foot or 1.5-acre minimums referenced above) as a universal figure.
- If the parcel sits near Valley View, ask whether it also falls inside that city's ETJ, which can layer additional municipal subdivision requirements on top of the county's Lake Ray Roberts zoning district rules.
- Ask the same office for the current Lake Ray Roberts Comprehensive Plan and any pending zoning amendments before finalizing a purchase or development plan.
