Buying Rural Land in Ellis County, Texas
Ellis County -- Waxahachie and Midlothian, just south of Dallas along I-35E -- is one of the fastest-growing counties in North Texas, gaining roughly a quarter of its population in five years. Its rural land runs under a single countywide groundwater district and county-adopted subdivision rules, both worth understanding before buying acreage on the fringe.
Where the rural land is, and how fast that could change
Waxahachie (the county seat) and Midlothian account for most of Ellis County's growth and developed land, and land inside either city's limits or extraterritorial jurisdiction (ETJ) is governed by that city's own zoning and subdivision code, not this page. The county's remaining unincorporated land -- toward Ennis, Ferris, Red Oak, and the county's outer edges -- has genuinely grown as DFW's exurban expansion pushes south along I-35E, with the county adding roughly 48,000 residents between 2020 and 2025. That is fast growth by national standards, though it has not (at least as of this research) matched the near-complete rural-to-suburban conversion documented in some counties directly north of Dallas. Confirm ETJ status and any pending annexation plans directly with the nearest city before assuming a rural-looking parcel will stay that way.
Groundwater: one district, covering four counties
Groundwater across all of Ellis County -- along with neighboring Johnson, Hill, and Somervell Counties -- falls under the Prairielands Groundwater Conservation District (PGCD), created by the Texas Legislature in 2009. PGCD requires a permit application before a new well is drilled and a completion report once drilling is finished, and most rural residential wells in Ellis County draw from the Woodbine Formation, a sandstone aquifer that is the area's most common residential water source. Confirm current permit requirements, fees, and any exempt-well thresholds directly with PGCD before drilling.
Subdivision and septic: handled directly by the county
Ellis County has no general zoning ordinance for its unincorporated area, but it has adopted its own subdivision and development standards under Local Government Code Chapter 232, developed through the county's own planning work and administered by the Department of Development -- the same office that also handles OSSF (septic) permitting directly rather than routing it through a TCEQ regional office. Confirm current lot-size, road-frontage, drainage, and septic-permitting requirements directly with the Department of Development (972-825-5200, 109 S. Jackson St., Waxahachie) before planning a land split or a septic system.
Given how much of the county's outer land is still worked as pasture or cropland, a fair amount of it carries an agricultural (1-d-1 open-space) valuation with the Ellis Appraisal District rather than being taxed at full market value -- a genuine difference in annual carrying cost that a buyer shouldn't assume automatically continues under new ownership. Qualifying generally requires the land to have been used principally for agriculture for at least five of the preceding seven years, and both a change in ownership and a change in actual use (converting pasture to a homesite, for instance) can trigger a review or a rollback tax recapturing prior years' savings -- worth confirming directly with the appraisal district before treating a seller's existing exemption as guaranteed to carry over.
Who to Call Before Buying Land in Ellis County
Ellis County has no general zoning ordinance for its unincorporated area, consistent with the statewide default. For a parcel inside Waxahachie, Midlothian, Ennis, Red Oak, or another city's limits or ETJ, contact that city's own planning department instead of the county.
