Buying Land in Burnett County, Wisconsin

Burnett County, seat Siren, is northwest Wisconsin lake and river country along the St. Croix. Its zoning runs on two separate tracks -- general land-use zoning that applies only in the towns that have adopted it, and a shoreland overlay that applies everywhere near water regardless -- and a further wrinkle applies specifically along the St. Croix, where the National Park Service, not the county, controls a lot of what a private landowner can do.

County General Zoning Applies Only in Towns That Have Adopted It

Case-by-case / verify locally

Burnett County has adopted a general Land Use/Zoning Ordinance (Chapter 30 of the county code), administered by the county's Land Services Department in Siren, but Wisconsin's county/town zoning structure means it only governs land in towns that have opted in. County records identify at least Anderson, Blaine, Daniels, Dewey, Lincoln, Meenon, Rusk, Scott, Siren, and Union (among others) as county-zoned; some of the county's roughly 21 towns are not covered by the county ordinance and may be unzoned or handle land use on their own. Confirm the specific town's zoning status with Burnett County Land Services (715-349-2109) before assuming a parcel is zoned -- or unzoned -- based on where it sits in the county.

Shoreland Zoning Applies Countywide Regardless of a Town's General-Zoning Status

Generally favorable

Separately from Chapter 30, Burnett County administers a Shoreland Protection Ordinance (Chapter 45) implementing the statewide NR 115 standards within 1,000 feet of a lake/pond/flowage or 300 feet of a river/stream. Because Wisconsin law does not let a town withdraw from county shoreland zoning, this overlay applies the same way in every Burnett County town -- including ones with no general zoning of their own -- so a waterfront or near-waterfront parcel is subject to county setback and lot-size rules even in an otherwise unzoned town.

St. Croix River Frontage May Carry NPS Fee Ownership or a Scenic Easement, Not Just County Shoreland Zoning

Case-by-case / verify locally

Burnett County's stretch of the St. Croix River is part of the "Upper" St. Croix National Scenic Riverway, a federally designated Wild and Scenic River corridor the National Park Service manages directly -- through a combination of land it owns outright in fee (much of it now part of Governor Knowles State Forest) and scenic easements it holds on land that stays in private ownership. This is a different regulatory track than the county's NR 115 shoreland ordinance, which governs the rest of the county's lakes and rivers, and it is not something a standard zoning-map lookup will surface. See our dedicated page on this before assuming a St. Croix-adjacent parcel is unencumbered.

Zoning: confirm the town before assuming county or none

Burnett County Land Services (7410 County Road K, Suite 120, Siren, WI 54872; 715-349-2109; landservices@burnettcountywi.gov) administers the county's Chapter 30 Land Use Ordinance, which establishes zoning districts and permitted-use standards for the towns that have adopted it. Because Wisconsin's county and town general-zoning authority is mutually exclusive, the ordinance only reaches towns that agreed to be included -- a county-maintained "Zoned Townships" reference identifies a majority, but not necessarily all, of Burnett's roughly 21 towns as covered. Some towns in the county appear to be unzoned or to handle land use independently of the county ordinance, and this page could not verify a complete, current town-by-town list through direct access to the county's own site (see methodologyNote). Before buying, ask Land Services directly which zoning ordinance -- county, town, or none -- governs the specific town your parcel sits in, and get the applicable district and permitted-use list in writing.

Burnett County also maintains a separate subdivision ordinance (Chapter 58 of the county code) governing the platting and certified-survey-map process for dividing land, which is worth checking alongside general zoning if you're considering splitting a larger parcel.

Shoreland zoning: the one layer that applies everywhere

Chapter 45 of the Burnett County code, the county's Shoreland Protection Ordinance, implements Wisconsin's statewide NR 115 standards: within 1,000 feet of the ordinary high-water mark of a lake, pond, or flowage, or 300 feet of a river or stream, the ordinance sets structure setbacks (a 75-foot baseline from the water, consistent with the state minimum), vegetation-removal limits, and minimum lot sizes, with the county having revised the ordinance as recently as 2023 (Resolution 2023-07 / TXT-23-02). Because Wisconsin law does not allow a town to withdraw from a county's shoreland zoning ordinance the way it can withdraw from general zoning, Chapter 45 applies uniformly across every Burnett County town, including any that are unzoned or self-zoned for general land use. Given how many of the county's parcels sit near one of its many lakes or along the St. Croix, this shoreland layer is worth checking on almost any Burnett County property, not just ones that look waterfront on a map.

The St. Croix National Scenic Riverway: a different rulebook along the river

Burnett County borders the St. Croix River for a long stretch, most of it running through or alongside Governor Knowles State Forest -- a roughly 32,500-acre state forest (about 19,000 acres of it state-owned, with private inholdings) created specifically to buffer the federally designated St. Croix National Scenic Riverway. Unlike the Lower St. Croix segment further downstream (which runs through St. Croix and Pierce counties and is regulated mainly through county zoning standards under a separate rule, NR 118), Burnett County's segment is part of the Riverway's "Upper" section, where the National Park Service manages the corridor directly -- combining land it owns outright in fee with scenic easements recorded against parcels that remain privately owned. See our dedicated page on this for what that means for a specific St. Croix-adjacent parcel, since it is a materially different (and less visible) restriction than county shoreland zoning.

Septic, subdivision, and where to check parcel records

Onsite wastewater (POWTS) permitting in Burnett County -- private sewage system siting, soil evaluation, and inspection under the statewide SPS 383 code -- is administered through the same Land Services Department that handles zoning (715-349-2109), rather than a separate health department. Private wells fall under the Wisconsin DNR's statewide NR 812 well-construction rules rather than a county permitting process.

For parcel research, Burnett County's Property Information Division handles GIS/mapping and assessment records, the Register of Deeds (715-349-2183) holds recorded deeds and easements -- worth checking specifically for a St. Croix-adjacent parcel, since an NPS scenic easement is recorded against the deed -- and Extension Burnett County (715-349-2151) offers agricultural and land-use extension programming for the county's working farms and forestland.

Who to Call Before Buying Land in Burnett County

Direct WebFetch access to burnettcountywi.gov, library.municode.com, and nps.gov was blocked by a network egress restriction throughout this research pass, so department names, phone numbers, and the list of county-zoned towns reflect search-indexed content and document titles rather than a full verbatim read -- confirm current details, especially the zoning status of a specific town, directly with Burnett County Land Services before relying on them.
