Zoning in Juneau County, Wisconsin
Unlike many Wisconsin counties, Juneau County has never adopted a general zoning ordinance covering its unincorporated towns. That doesn't mean anything goes -- a countywide shoreland ordinance, subdivision rules, and septic code still apply everywhere -- but it does mean the single most basic zoning question (what can I build here, and how big must the lot be) has to be answered by the specific town, not the county.
This page covers what's specific to Juneau County. For the general explanation, see the national guide.
What the county actually regulates -- and what it doesn't
Wisconsin law lets a county choose whether to adopt general zoning for its unincorporated towns; if it doesn't, individual towns may adopt their own. Juneau County has taken the second path: its own code of ordinances, as indexed by Municode, includes a Shoreland-Wetland Zoning Ordinance (Appendix A -- the state NR 115-mandated overlay covering land within 1,000 feet of a lake/flowage or 300 feet of a river/stream) and a separate Chapter 23 Land Division Ordinance governing subdivision of land, but no general/comprehensive zoning ordinance of its own. Juneau County Zoning & Sanitation (650 Prairie Street, Mauston; (608) 847-9391) administers both of these countywide ordinances, plus septic (POWTS) permitting under the state SPS 383 standard.
What this means in practice: if your parcel is within the shoreland band, or if you're splitting a parcel into multiple lots, the county has a direct say regardless of which town you're in. Outside the shoreland band, though, the county's zoning ordinance simply doesn't reach -- general land-use questions (what uses are permitted, minimum lot size, setbacks from a property line, whether a mobile home or accessory dwelling is allowed) are answered by the town, if the town has adopted zoning at all.
Which towns are confirmed to have their own zoning
Juneau County has 19 towns, and this research pass could not obtain a complete, verified list of which have adopted their own general zoning ordinance and which have not (a status that can also change over time as a town board votes to adopt, amend, or repeal one). Search-indexed town ordinance pages confirm that the Towns of Germantown, Lyndon, Lisbon, and Orange each maintain their own zoning code. Some Wisconsin counties with no county general zoning have a mix of towns that have adopted their own ordinance and towns that have adopted none at all (leaving those areas with only the state-mandated shoreland overlay and any applicable state building code) -- this research pass could not confirm which pattern applies to Juneau County's remaining towns, so don't assume either way for a town not listed here.
What to actually do before buying
- Identify the specific town your parcel sits in, and contact that town's clerk or zoning administrator directly to ask whether the town has adopted its own general zoning ordinance, and if so, what district the parcel falls in and what it permits.
- Separately confirm with Juneau County Zoning & Sanitation whether the parcel falls within the statewide shoreland zone (1,000 feet of a lake/flowage, including Petenwell or Castle Rock Lake, or 300 feet of a river or stream) -- this applies regardless of the town's own zoning status.
- If you're planning to split the parcel from a larger one, confirm the county's Land Division Ordinance (Chapter 23) requirements with the same county office, since this applies countywide independent of general zoning.
- If the town has no zoning ordinance at all, ask directly what that means in practice for your intended use -- the absence of local zoning doesn't eliminate state-level requirements (shoreland zoning, floodplain rules, septic/well codes, and the state Uniform Dwelling Code for one- and two-family homes) that still apply.
- Don't assume a neighboring town's zoning rules, or a rule you've read about for a different Wisconsin county, applies here -- Juneau County's town-by-town structure means the answer can differ from one town line to the next.
