Buying Land in Pepin County, Wisconsin
Pepin County, seat Durand, is Wisconsin's smallest county by area -- a strip of Mississippi River bluff country best known as Laura Ingalls Wilder's birthplace. Unlike most Wisconsin counties, Pepin County has no general zoning ordinance of its own: land use outside the state-mandated shoreland and floodplain bands is governed town by town, and three of its eight towns appear to have no zoning at all.
Zoning: no county ordinance -- five towns zone themselves, three appear not to
Pepin County's Land Conservation & Planning Department (740 7th Ave. W, Durand, WI 54736; zoning line (715) 672-8897) administers the zoning regulations Pepin County itself has adopted -- but that set is narrower than in most Wisconsin counties, because Pepin County has never adopted a general, comprehensive zoning ordinance covering land use countywide. Instead, general zoning here is a town-by-town patchwork: five of the county's eight towns run their own zoning ordinance (Frankfort, whose ordinance was adopted July 31, 2013; Pepin; Stockholm, which also has its own Conservation Subdivision Ordinance; Waterville, adopted February 22, 2017; and Waubeek), and the incorporated City of Durand and Villages of Pepin and Stockholm each administer their own separate municipal zoning. The remaining three towns -- Albany, Durand (the town, distinct from the city of the same name), and Lima -- did not turn up an identified zoning ordinance of their own in this research pass, which combined with the county's lack of general zoning suggests land there is effectively unzoned for general land-use purposes outside the overlay layers below. Confirm this directly with the county before assuming it, since a town's zoning status can change.
What Pepin County does administer countywide, regardless of a parcel's town-zoning status, are three narrower layers: a Shoreland Protection Ordinance (Chapter 16) covering the state-mandated NR 115 band (1,000 feet of a lake, pond, or flowage; 300 feet of a navigable river or stream) plus all DNR-identified wetlands in the county; a Floodplain Zoning Code (Chapter 20), also state/federally mandated; and a Highway Setback ordinance requiring a county land-use permit before erecting, moving, or structurally altering a structure within 63 feet of a town-road centerline, 75 feet of a county-road centerline, or 110 feet of a state-highway centerline -- but only in the Towns of Lima, Pepin, and Stockholm specifically, not countywide.
On top of all of that, the Towns of Pepin and Stockholm carry a fourth, more distinctive layer: the Mississippi River Bluffland Zoning Code (Chapter 19), adopted in the early 1990s specifically to protect the steep bluff terrain along the river in these two towns from groundwater contamination and soil erosion, and to control building placement and land use there. Anyone building in the mapped bluffland area of Pepin or Stockholm needs a land-use permit and must meet special setback requirements beyond the county's ordinary shoreland or highway-setback rules. See our dedicated zoning page for the full town-by-town breakdown and what each layer means in practice.
Septic (POWTS), wells, and subdivision review
Pepin County administers septic systems as Private Onsite Wastewater Treatment Systems (POWTS) under Chapter 15 of the county code (the Sanitary Code), a state-mandated program applying countywide regardless of town zoning status. A Wisconsin Certified Soil Tester evaluates the site, a licensed plumber designs and installs the system based on that evaluation, and the county issues the sanitary permit and inspects the installation -- the same two-step soil-evaluation-then-permit sequence used statewide under SPS 383, run here through the Land Conservation & Planning Department rather than a separate sanitarian office. Private wells fall under the Wisconsin DNR's statewide NR 812 well-construction rules, administered by the DNR rather than the county.
Land divisions and platting are governed countywide by Chapter 18 of the county code (Subdivision and Platting), which -- unlike general zoning -- applies regardless of which town a parcel sits in, giving the county a real hand in how larger parcels get split even in the towns it doesn't otherwise zone.
Mississippi River bluff country and Laura Ingalls Wilder tourism
Pepin County's western edge runs along Lake Pepin, a natural widening of the Mississippi River, with steep river bluffs rising above the valley floor -- the terrain the county's Bluffland Zoning Code was written to address. The county is also a small but real tourism draw as the birthplace of Laura Ingalls Wilder: she was born February 7, 1867, in a log cabin near the Town of Stockholm, and the Little House Wayside, a 3-acre rest area on County Highway CC roughly seven miles northwest of the Village of Pepin, holds a replica cabin open year-round for self-guided visits. The Village of Pepin hosts an annual Laura Ingalls Wilder Days celebration each September. This tourism draw is modest relative to Wisconsin's larger resort counties, but it's worth knowing if evaluating land near Pepin or Stockholm for a use tied to visitor traffic.
GIS/land records and other offices to know
Pepin County parcel and tax data is accessible through the county's ArcGIS-based parcel/tax viewer, maintained by the Land Information function; the Register of Deeds ((715) 672-8856) holds recorded deeds, easements, and plats (with online access through the Tapestry/Fidlar system), and the Treasurer ((715) 672-8850) handles property tax payment and maintains parcel maps showing property lines, structures, and values.
Extension Pepin County (740 7th Ave. W, Durand, WI; (715) 672-5214) provides agriculture and horticulture support, sharing a regional agriculture educator (Mary Wood) with neighboring Buffalo County -- relevant given the county's mix of Mississippi River bottomland, bluff terrain, and more conventional farmland toward Durand.
