Tribal Trust Land Status in Shawano County, Wisconsin
Shawano County's tribal-land picture is more layered than "borders the Menominee Reservation." It holds a genuine Stockbridge-Munsee reservation checkerboard across two towns, and -- contrary to the common assumption that Menominee County and the Menominee Reservation are simply the same shape -- a documented, small piece of the Menominee Reservation itself sits inside Shawano County's borders.
This page covers what's specific to Shawano County. For the general explanation, see the national guide.
Stockbridge-Munsee Community: a real checkerboard across two towns
The Stockbridge-Munsee Community, also known as the Band of Mohican Indians, holds a reservation covering 24.03 square miles (22,139 acres total) spread across the Towns of Bartelme and Red Springs in Shawano County. Of that total, 16,255 acres are held in trust and 5,884 acres are fee land -- a genuine checkerboard of trust and non-trust parcels within the reservation boundary, rather than one solid tribal block. The Community operates the North Star Mohican Casino Resort and is reported to be Shawano County's single largest employer, with roughly 740 employees.
For a buyer, the practical distinction is the same one that applies near any Wisconsin reservation: trust land is held by the federal government for the tribe's or its members' benefit, generally isn't available for ordinary purchase, and sits outside standard Shawano County zoning, building-permit, and septic-permit jurisdiction. Fee land within the reservation boundary can change hands like other Wisconsin property, but its exact status -- and which authority actually administers permitting for it -- should be confirmed directly with both Shawano County Planning and Development and the Stockbridge-Munsee Community's own land office before assuming either regime automatically applies.
Middle Village: a documented piece of the Menominee Reservation, inside Shawano County
Menominee County and the Menominee Indian Reservation are usually described as essentially coterminous -- Menominee County was created in 1959-1961 specifically to match the reservation's boundary during the era of federal tribal termination, using land carved from Shawano and Oconto Counties. That framing is close to accurate, but not exact: Middle Village, a roughly 1.96-square-mile parcel purchased by the Menominee Tribe and later placed into federal trust, sits in the Town of Red Springs in Shawano County -- outside Menominee County's own boundary -- and is nonetheless legally part of the Menominee Indian Reservation as off-reservation trust land incorporated into the reservation. It functions as a tribal housing development, with all of its land held in federal trust.
This is worth knowing specifically rather than assuming away, because the common mental model ("the Menominee Reservation is Menominee County, and Shawano County only borders it") is not quite right. A parcel in or immediately around the Town of Red Springs should be checked directly for proximity to Middle Village, in addition to whatever Stockbridge-Munsee-related check applies to the same town -- Red Springs is the one town in Shawano County where both tribal nations' land questions can come up.
No confirmed court ruling limits county zoning near either tribe's land here
Buyers familiar with Bayfield County's Red Cliff Reservation situation -- where a 2020 federal court ruling barred the county from enforcing its zoning ordinance against certain reservation fee land -- should not assume an equivalent ruling applies in Shawano County. This research pass found no court decision analogous to Red Cliff Band v. Bayfield County addressing either the Stockbridge-Munsee Community's reservation or the Middle Village Menominee trust parcel, and does not assert one exists. That absence of a comparable ruling doesn't necessarily mean Shawano County zoning reaches every fee parcel within either area the same way it would elsewhere in the county -- federal Indian law in this area is fact-specific and can turn on the particular reservation's history and any tribal ordinances of its own -- but it does mean a buyer shouldn't import Bayfield's specific legal conclusion into Shawano County without independent confirmation.
What to actually check on a parcel near either tribal nation's land
- Run a title search and pull the parcel through Shawano County's GIS parcel viewer to determine its current ownership category -- Stockbridge-Munsee trust, Stockbridge-Munsee fee, Menominee trust (Middle Village), or unrelated -- rather than relying on a general map showing only the main reservation boundaries.
- For any parcel in the Towns of Bartelme or Red Springs, confirm directly with the Stockbridge-Munsee Community's tribal government whether the specific parcel or land immediately adjacent to it is trust or fee land.
- For any parcel in or near the Town of Red Springs specifically, also ask about proximity to the Middle Village trust parcel -- don't assume Menominee Reservation land is confined to Menominee County.
- For a fee parcel near or within either area, confirm with both Shawano County Planning and Development and the relevant tribal government which permitting regime applies, rather than assuming county rules automatically carry over the way they would for an ordinary Shawano County parcel.
- Ask directly whether either tribe has an active land-acquisition or land-into-trust effort underway near a specific parcel, since -- as the Middle Village history itself shows -- tribal land holdings and reservation boundaries in Wisconsin can and do change over time.
