Buying Land in Sublette County, Wyoming
Sublette County has genuine tiered zoning, but the two things most likely to matter to a land buyer here aren't in the zoning code at all: a huge natural-gas field where the federal government owns most of the surface and minerals, and one of the longest big-game migration routes in North America running straight through the county.
Zoning: a menu of density tiers, not one flat rural district
Sublette County's Zoning and Development Regulations, authorized under Wyoming Statutes 18-5-201 through 18-5-207 and built to implement the county's 2003 Comprehensive Plan (amended 2005), set out a genuinely tiered system rather than a single agricultural catch-all. Agricultural (A-1) land maintains existing farm and ranch use; Rural Residential districts come in three sizes -- RR-5, RR-10, and RR-20, named for their 5, 10, and 20-acre minimum parcel sizes -- giving a buyer a real choice of density rather than a single default. A Resource Conservation (RC) district limits development on environmentally sensitive land, and a Scenic Areas, Historic Sites & Trails (SA) district protects specific mapped features. A Planned Unit Development (PUD) overlay is also available for projects that want to trade standard lot dimensions for clustered design.
Because the county revisits and amends this code fairly regularly (recent audit and comment drafts run through at least 2024), always confirm the current district and its standards directly with Sublette County Planning & Zoning rather than relying on an older copy of the regulations.
Septic: county-administered under a state delegation agreement
Sublette County -- unlike the handful of Wyoming counties where DEQ permits septic systems directly -- regulates septic ("small wastewater") systems itself under a delegation agreement with Wyoming DEQ, applying the same underlying state design standards through its own county permit process. A conventional system needs wastewater flow under 2,000 gallons per day, seasonal high groundwater/bedrock/impervious clay at least four feet below the leachfield, and a percolation rate between 5 and 60 minutes per inch. A one-acre minimum site (excluding rights-of-way, streams, or lakes) is required where a domestic well and a septic tank/leachfield system share a lot. Once issued, a permit is valid for two years, and the county inspects before backfill.
Split estate: the Pinedale Anticline and Jonah Field cover a large share of the county
Sublette County sits on top of two of the country's most productive onshore natural gas fields. The Pinedale Anticline Project Area covers roughly 197,000 acres in central Sublette County -- about 80% federally owned surface managed by the BLM, with roughly 5% state and 15% private surface -- and a 2008 federal Record of Decision planned for more than 4,000 additional wells over an estimated 40 years of production. The Jonah Field, in southern Sublette County, is even more heavily federal, at roughly 98% BLM-managed surface. It's common here for the surface and mineral rights to be owned separately, and Wyoming's Split Estate Act sets out a specific notice, negotiation, and surface-use-agreement process an operator has to follow before disturbing a surface owner's land -- see our dedicated page on easements and split estate in Sublette County for the actual mechanics: notice periods, what a surface use agreement has to cover, the bond fallback if negotiations fail, and current well-setback distances.
A real, mapped wildlife migration corridor runs through the county
The Sublette pronghorn herd makes one of the longest large-mammal migrations documented in North America -- roughly 165 miles between summer range near Grand Teton National Park and winter range in the Red Desert to the south, much of it through Sublette County. Wyoming Governor Mark Gordon's 2020 Migration Corridor Executive Order created a framework where state regulatory agencies condition permits to preserve corridor function, with the strictest protections reserved for narrow "bottleneck" segments (a small fraction of the corridor's total acreage); private parcels and pre-existing land agreements are generally excluded from the strictest layer. As of this writing, a state-appointed local working group has been actively developing specific protection recommendations for the Sublette corridor.
This is a state-level framework, not a Sublette County zoning rule, and it mainly affects state and federal permitting decisions rather than private land use directly -- but a buyer considering land inside a mapped corridor segment, especially near a bottleneck, should factor in that future development-related permits on or near that land could be conditioned to protect migration function.
Who to Call Before Buying Land in Sublette County
Sublette County's Planning & Zoning Department is the single office for zoning, building, septic, and subdivision questions. Recorded mineral and surface ownership history on federal split-estate land inside the Pinedale Anticline or Jonah Field is not a county function -- title work on those parcels should specifically check BLM and Wyoming Office of State Lands and Investments records, not just the county recorder's deed history, given how much of both fields sits on federal surface and minerals. We could not verify a dedicated Sublette County UW Extension office contact as of this writing; if agricultural extension support is needed, confirm the current Sublette County office directly with University of Wyoming Extension.
