Zoning and Federal Land in Brevard County, Florida
Before you evaluate a parcel anywhere near Merritt Island or the Kennedy Space Center area, understand this: a large share of that part of Brevard County isn't zoned by the county at all -- it's federal land. Here's how the boundary between private and federal land actually works here.
This page covers what's specific to Brevard County. For the general explanation, see the national guide.
Two federal land categories, not one
Northern Brevard County contains two distinct kinds of federal land that a buyer needs to tell apart. First, Kennedy Space Center (NASA) and the adjacent Cape Canaveral Space Force Station occupy an operational federal enclave -- active launch and support infrastructure, off-limits to private ownership or development, with public access restricted for safety and security reasons. Second, Merritt Island National Wildlife Refuge, established in 1963 and managed by the U.S. Fish and Wildlife Service, overlaps much of the buffer land surrounding the space center -- land set aside both as an operational safety buffer for the space program and, separately, as protected coastal scrub, marsh, and estuarine habitat.
Together, these two categories mean a very large share of the northern part of the county -- most of Merritt Island north of the developed areas around Merritt Island (the community) and Titusville -- is either active federal operational land or a permanently protected wildlife refuge, not an inventory of buildable private parcels waiting to be zoned.
Why this matters more here than the general 'check federal land' advice
Most Florida counties don't have a comparable situation -- a federal enclave of this scale, paired with a wildlife refuge that overlaps its buffer, sitting adjacent to populated, ordinarily-zoned communities. In Brevard County, the transition from private, county-zoned land to federal land can occur over a fairly short distance, which means a parcel that looks, on a basic map, like it's simply undeveloped rural land near the coast may in fact be adjacent to (or in some cases mistakenly assumed to be within) refuge or spaceport-buffer land that was never available for private purchase.
This is also relevant if you're specifically drawn to the area because of its undeveloped character or wildlife viewing -- that character is substantially a product of the refuge's protected status, not a market opportunity waiting to be developed. Anyone hoping to buy land specifically because it looks similar to refuge land, expecting future development potential, should treat that expectation with real skepticism.
What to check before buying land near the Space Coast federal enclave
- Get a current parcel survey and title search that clearly establishes the boundary between the private parcel and any adjacent federal (NASA, Space Force, or US Fish and Wildlife Service) land -- do not rely on a general map view alone.
- Confirm current zoning designation and permitted use directly with Brevard County Planning & Development for any parcel near Merritt Island or the space center periphery.
- If the parcel borders the refuge, ask the US Fish and Wildlife Service's Merritt Island refuge office whether any buffer, easement, or access restriction applies to the specific parcel.
- Understand that public access to some roads and areas near the space center can be affected around launch events -- ask directly about any access pattern relevant to a specific parcel's road frontage.
- Don't assume undeveloped-looking land near the refuge or space center has development potential; confirm its actual ownership and zoning status before making any assumption about future use.
