Wind and Solar Leasing in Kossuth County, Iowa

Kossuth County, Iowa's largest by land area, is already home to two utility-scale wind projects and just adopted a new zoning ordinance to govern utility-scale solar after an 18-month moratorium. If you're evaluating a lease offer or buying land near a project, the rules here have changed recently and are worth confirming directly rather than assuming an older summary still applies.

This page covers what's specific to Kossuth County. For the general explanation, see the national guide.

Wind: an established industry presence with a live setback debate

Kossuth County has been a real, operating location for utility-scale wind power for years, not just a candidate site. The 207-MW Ledyard Windpower project, developed by Duke Energy Sustainable Solutions as its first Iowa wind project, and the roughly 70-MW Kossuth County Wind Farm are both sited in the county. Local siting rules trace back to a wind ordinance the Board of Supervisors adopted around 2017 on a 4-1 vote after what contemporary reporting (Wind-Watch, the Globe Gazette) described as strong local opposition -- an 11-page ordinance defining a wind energy conversion system and setting out setback regulations, a limit on turbine numbers, and an application process.

That ordinance has not stayed static. As of a July 29, 2025 Board of Supervisors meeting, officials were still actively discussing whether the current 200-foot turbine setback from the road right-of-way is adequate, alongside broader property-line setback questions -- the WECS ordinance separately sets a 600-foot minimum setback from any public conservation area, and setbacks for some property types are reportedly waivable by mutual agreement. If you're weighing a wind lease offer on Kossuth County land, or buying a parcel near an existing turbine, treat any setback figure you find in older reporting as a starting point to verify, not a final answer -- call Kossuth County Planning and Zoning at (515) 295-3813 for the ordinance's current, in-force text before you sign anything or close on a purchase.

Solar: from a 2024 moratorium to a new ordinance in March 2026

Unlike wind, Kossuth County had no dedicated utility-scale solar ordinance until very recently, and the path to one was contentious and multi-staged. In early August 2024, the county's Planning and Zoning Commission recommended that no permits be issued for large-scale or utility-scale commercial solar arrays in the county for nine months, to give officials time to study solar's impact. The Board of Supervisors approved a first reading of the moratorium in early September 2024, and board proceedings from September 3, 2024 record a roll-call vote (four supervisors voting yes, one abstaining) adopting it as an amendment to the county zoning ordinance -- a temporary halt on processing any application to construct large-scale or utility-scale solar systems anywhere in the county.

That moratorium did not expire on schedule. In June 2025 the Board voted to extend it through December 31, 2025, and in December 2025 the Board approved Ordinance No. 320-b, extending it again through March 31, 2026 or until a replacement ordinance took effect, whichever came first. A September 2, 2025 Board discussion, reported while the moratorium was still in force, debated a proposed 500-foot setback from occupied residences for solar installations and a proposed regulatory threshold (a project generating 10 megawatts or occupying 30 contiguous acres) for what would count as 'utility-scale' -- notably, board members and commenters in that meeting observed that solar had drawn far less public opposition locally than wind had. On March 24, 2026, the Board adopted Ordinance 320-C, a solar-specific amendment to the county zoning ordinance regulating construction and operation of utility-scale solar energy systems in unincorporated Kossuth County, which replaced the moratorium ahead of its scheduled March 31, 2026 end date.

For a buyer or landowner today, the practical takeaway is that Ordinance 320-C is now the governing rule for any utility-scale solar project in unincorporated Kossuth County -- and because it is only months old as of this review, published third-party summaries of Kossuth County's solar rules should be treated with caution unless they specifically cite the March 2026 ordinance. Get the current ordinance text, including its final setback distances, project-size thresholds, and any decommissioning or bonding requirements, directly from Kossuth County Planning and Zoning ((515) 295-3813 or zoning@kossuthcounty.iowa.gov) before evaluating a solar lease offer or a parcel near a proposed project.

What this means for a lease offer or a land purchase near a project

If you're a landowner weighing a wind or solar lease offer in Kossuth County, two things follow from the picture above. First, the county's rules are genuinely in flux -- wind setbacks are under active board discussion and the solar ordinance is brand new -- so any lease terms you're offered should be checked against the current county ordinance, not against what a developer's boilerplate summary says about 'typical' Iowa county rules. Second, ask the developer directly which ordinance and which specific setback and siting provisions apply to your parcel, and get that in writing before signing, given how recently the applicable solar rule changed. If you're instead buying land near an existing turbine or a proposed solar site, ask the seller and confirm with the county whether the parcel falls within any required setback of a turbine or planned solar array, and whether any easement or lease already runs with the land -- a wind or solar lease is typically recorded and can bind a subsequent buyer, so a title search covering recorded leases and easements is worth doing specifically for this reason in a county this active in renewable siting.
