Buying Land in Delta County, Michigan
Seat Escanaba, on Green Bay in Michigan's Upper Peninsula. Delta County is a genuine exception to Michigan's usual township-first zoning pattern: the county directly administers building and zoning permits for ten of its townships, while the cities of Escanaba and Gladstone and the Village of Garden run their own separate zoning. The county's Lake Michigan/Green Bay shoreline also carries EGLE-regulated dune and erosion rules worth checking early.
Zoning: the county directly administers it for ten townships -- a real exception to Michigan's norm
Delta County stands out from most of rural Michigan's township-first zoning pattern under the Michigan Zoning Enabling Act: the county's own Building & Zoning Department directly issues both building and zoning permits for ten named townships -- Baldwin, Bay de Noc, Brampton, Cornell, Ensign, Fairbanks, Garden, Maple Ridge, Nahma, and Wells -- rather than each of those townships running its own independent ordinance. The remaining jurisdictions -- the cities of Escanaba and Gladstone, plus the Village of Garden -- maintain their own separate zoning and operate their own planning commissions, independent of the county.
A May 2022 news report describes Delta County weighing whether to pass zoning authority to the individual townships instead, driven partly by cost. That didn't happen: the county's own December 2024 Board of Commissioners minutes show it renewing its Building and Zoning Township Zoning Contracts with a fee increase, and the county followed up in June 2025 by creating a new Planning Commission -- both signs of a county reinvesting in this role rather than stepping back from it. See our dedicated zoning page for Delta County for the full history and what it means for a specific township.
Shoreline land: Critical Dune Areas and erosion risk on Green Bay and Lake Michigan
Delta County's Lake Michigan and Green Bay shoreline brings EGLE's coastal permitting programs into play for waterfront parcels. The county has designated Critical Dune Areas subject to NREPA Part 353, meaning construction, driveway installation, septic system placement, or vegetation removal within one of those areas requires an EGLE permit regardless of local zoning. Separately, Delta County completed a shoreline Recession Rate Study in 2022, part of the state's systematic High Risk Erosion Area (NREPA Part 323) program, which identifies shorelines eroding at an average of one foot per year or more over at least 15 years and sets construction setbacks -- generally 30 years' worth of projected erosion for smaller, moveable structures and 60 years' worth for larger structures like homes with foundations over 3,500 square feet or septic systems. Check both programs' current maps for any specific Delta County shoreline parcel before assuming a standard building or septic permit is all that's required.
A modest Sault Tribe trust-land presence worth noting
Delta County also has a small documented presence of Sault Ste. Marie Tribe of Chippewa Indians trust land -- a 2014 tribal court filing cites approximately 20 acres in the county, part of the Tribe's broader, scattered eastern-and-central-Upper-Peninsula trust holdings concentrated mainly in Chippewa County. Given the modest and dated size of this figure, this page doesn't treat it as a major factor for most Delta County land buyers, but it's worth being aware that a specific parcel's neighbor could, in principle, be tribal trust land rather than private fee land -- confirm any specific concern directly with the county's GIS/parcel records or the Tribe itself.
Septic and wells: a two-county health department
Michigan has no statewide septic code, and Delta County's authority sits with Public Health of Delta & Menominee Counties, a two-county health department serving both Delta and neighboring Menominee County. Its Environmental Health Division issues permits for On-Site Sewage Treatment/Disposal Systems (OSTDS, the department's own term for septic systems) and administers the county's Water Well Program. As with the rest of Michigan, well permitting itself follows the statewide Well Construction Code (Public Health Code Part 127), administered locally by this same department.
Who to Call Before Buying Land in Delta County
Direct WebFetch access to deltacountymi.gov and phdm.org was not attempted in this research pass, so department details reflect search-indexed content rather than a full verbatim read -- confirm current staff, hours, and fees directly before relying on this page for a specific parcel, and specifically confirm whether the county-administered zoning structure for its ten townships has changed since a May 2022 report describing a possible shift to township-level zoning.
