Zoning in Delta County, Michigan: A County That Actually Zones Its Townships
Most Michigan counties leave zoning entirely to their townships. Delta County does the opposite for ten of them, directly administering zoning and building permits under paid township contracts -- and in late 2024 the county chose to keep doing that rather than hand the job back, as it had publicly considered in 2022.
This page covers what's specific to Delta County. For the general explanation, see the national guide.
Ten townships, one county zoning department -- confirm which side of the line a parcel is on
Delta County's Building & Zoning Department directly issues both zoning and building permits for ten named townships: Baldwin, Bay de Noc, Brampton, Cornell, Ensign, Fairbanks, Garden, Maple Ridge, Nahma, and Wells. That's the opposite of the pattern in most of rural Michigan, where the township is the zoning authority and the county, if it zones at all, only fills gaps. In Delta County it runs the other way: the county is the zoning authority for these ten townships specifically, under service contracts the county bills back to each township on a per-parcel basis.
The cities of Escanaba and Gladstone and the Village of Garden are the exceptions -- each maintains its own separate zoning ordinance and planning commission, independent of the county. So for any Delta County parcel, the first question isn't "what does Delta County zoning say" in the abstract -- it's whether the parcel sits in one of the ten county-administered townships or in one of the three self-zoned municipalities, since the applicable ordinance, fee schedule, and office are different in each case.
2022: the county seriously considered handing zoning back to the townships
This arrangement was not a settled, static fact even a few years ago. A May 2022 news report (Delta County may pass zoning to townships) described county commissioners weighing whether to end county-run zoning and let each of the ten townships run its own instead, similar to how most other Michigan counties operate. Commissioners put real numbers behind the question: running zoning for the affected townships was then costing the county about $120,000 a year, against an estimated $80,000-90,000 annual cost for a single dedicated zoning enforcement officer -- and county officials estimated a full transfer of zoning authority to the individual townships would take roughly a year to complete once a decision was made.
That's worth knowing even though it didn't happen, because it shows this structure has been an active, cost-driven policy question for the county rather than a permanent fixture -- and it could resurface. A parcel's zoning authority here has a real, documented history of almost changing.
What the county actually decided: keep county zoning, renew the contracts
This research pass tracked the question past the 2022 reporting to find its resolution. Delta County's own Board of Commissioners meeting minutes from December 3, 2024 show the board taking up "Building and Zoning -- Township Zoning Contracts" and approving renewed contracts with the ten townships that include a $0.25-per-parcel fee increase. In other words: as of that meeting, the county chose to continue running zoning for its ten townships under updated, slightly more expensive service contracts -- not to hand the function over to the townships as the 2022 proposal had contemplated.
The county followed that up in June 2025 by adopting Ordinance #2025-2, establishing a Delta County Planning Commission to develop coordinated, county-wide development planning. Together, these two 2024-2025 actions point toward a county reinvesting in its zoning-administration role rather than stepping back from it -- but confirm the current arrangement directly with the county's Building & Zoning Department before relying on it, since a per-parcel fee structure and township-by-township contracts are, by design, the kind of thing that can be renegotiated again at a future contract renewal.
What this means if you're buying land in one of the ten townships
- Confirm which of the two zoning regimes applies to a specific parcel first: the county's own Zoning Ordinance (for Baldwin, Bay de Noc, Brampton, Cornell, Ensign, Fairbanks, Garden Township, Maple Ridge, Nahma, or Wells Township) or a self-administered municipal ordinance (Escanaba, Gladstone, or the Village of Garden -- note Garden Township and the Village of Garden are different jurisdictions).
- For a parcel in one of the ten county-administered townships, the Delta County Building & Zoning Department is the correct first call for both zoning-district and building-permit questions -- not the township hall.
- Ask directly whether the per-parcel contract fee (increased by $0.25 as of the December 2024 renewal) or any other cost of the arrangement is billed through to property owners in any way, or is purely an intergovernmental cost between the township and county.
- Because this structure has been an active policy question before (2022) and the contracts are renewed periodically, don't assume the county-administered arrangement is permanent -- ask the Building & Zoning Department whether any further change is under discussion.
- If a project needs county-level plan review specifically, ask whether it now falls under the new County Planning Commission created by Ordinance #2025-2 (June 2025) rather than only the Building & Zoning Department's permit process.
