Well Water Inside the Flathead Reservation, Lake County

The hub covers why water rights inside the Flathead Reservation run through a separate board instead of DNRC. This page covers what that means specifically for a well: a different permitting sequence, a closed registration window for older wells, and what to check before you buy a property that depends on one.

This page covers what's specific to Lake County. For the general explanation, see the national guide.

A new well here needs board preapproval before you drill -- not after

Off-reservation in most of Montana, a small-capacity domestic well can typically be drilled under DNRC's exempt-well provisions without applying for a water right first, with paperwork filed after the fact. Inside the Flathead Reservation boundary, that sequence doesn't apply. The Flathead Reservation Water Management Board (FRWMB), created under the 2015 CSKT-Montana Water Compact, is the sole authority for water-right permitting and changes within the reservation, and its published guidance states plainly that everyone -- tribal and non-tribal, on fee land or trust land -- needs advance authorization before drilling a new well for a new use. In practice, that means securing FRWMB preapproval is a required step before well construction begins, not a formality to complete afterward.

If you're buying vacant or unimproved land in Lake County with plans to drill a well for a house, irrigation, or livestock, build the FRWMB preapproval step into your project timeline before you schedule a drilling contractor. This applies regardless of whether the specific parcel is fee land or trust land -- the Board's jurisdiction is geographic (anywhere within the reservation boundary), not tied to land-ownership status.

Older wells: the registration window for undocumented uses has closed

The Compact created a one-time, 180-day window for landowners to register certain previously unrecorded water uses that had never received a formal Montana DNRC water right -- including existing domestic wells, other groundwater uses, and stockwater uses put to use on or before the Compact's September 17, 2021 effective date. That registration window closed March 16, 2022. If a Lake County property has an older well that was never issued a state water right and was never registered with DNRC or the Board during that window, its status is not something you can simply resolve today by filing a late registration form the way you might off-reservation -- it needs to be raised directly with the FRWMB as an individual matter.

This is a real, practical due-diligence item for an older property: ask the seller whether the existing well has a recorded state water right or FRWMB registration, and if neither exists, ask the Board directly what options (if any) remain for resolving an undocumented older well's status, rather than assuming the property's water use is automatically grandfathered in.

What to ask before you buy

  • For a property with an existing well: request documentation of either a Montana DNRC-issued water right predating the Compact, or FRWMB registration completed before the March 16, 2022 deadline.
  • For vacant land where you plan to drill: contact the FRWMB for preapproval requirements and timeline before budgeting a well into your construction schedule -- do not assume you can drill first and file paperwork after, as you might off-reservation.
  • Confirm the parcel is actually within the reservation boundary (nearly all of Lake County is, but boundary edges should still be confirmed) since this entire framework is geographic rather than tied to fee/trust status.
  • For background on the Compact itself and how it changed water administration countywide, see the Lake County hub and Montana DNRC's Flathead Compact page.
